Terms of Service

The site http://www.imtaa.org, owned by International Medical Tourism Agencies Association is an information platform for participants of the medical tourism market, and redirects registered users to the online-service EasyCase, based on the contractual relationship between the two sites.

Online service EasyCase (https://www.easycasemed.com) is an internet site known as www.easycasemed.com operated by EasyCase Systems Inc. which provides its users with search, compare and coordination of medical services of healthcare providers all over the globe.

Online service EasyCase is a private resource and is managed in accordance with the policy determined by the Administration. By registering on the online-service EasyCase, you confirm that you have read this Terms of Service, understood your rights, obligations, conditions and clauses contained in this document and agree to abide them. The Terms of Service comes into effect from the moment you express your consent to register on the online-service EasyCase.

1.Terms and definitions

User is an individual or entity registered at the online-service EasyCase and granted with access to Agent inquiries database.

Provider is a user of the online-service EasyCase or an entity providing medical services or assisting services for patients.

Agent is a user of the online-service EasyCase, individual or entity gathering requests for treatment from potential patients and placing them in Agent inquiries database in order to get treatment plan/second opinion from Providers.

Agent inquiry is a personal and health condition data got and prepared by Agent from Patient with the patient’s consent, available in Agent inquiries database for Providers and Partners chosen by Agent.

Agent inquiries database is a list of actual Agent inquiries at the current moment, placed by Agents at the online-service EasyCase and available for Provider according to its specialties, country and other parameters.

Patient is an individual applied to Agent for getting offers of treatment plans or second opinion possibilities according to his medical documents and health condition.

Partner is an entity or an individual that Provider has a signed cooperation Agreement.

Privileged Agent / Privileged Partner is a Partner invited by Provider in the online-service EasyCase and added to the Privileged Agent List during 60 days after Provider registration and the date of Provider’s authorization for access to Agent inquiries database by EasyCase management. Partner could get the status of Privileged Agent only if he sent at least six patients to Provider for the last 180 days before the registration date of Provider.

Privileged period is the period of 240 days after the date of Provider’s authorization for access to Agent inquiries database when the EasyCase service of access to inquiries from Privileged Partners in Agent inquiries database is granted for free. 240 days period consists of two periods:

  • 60 days after the date of Provider’s authorization for access to Agent inquiries database, within the forming the list of Privileged Partners is available;
  • Additional 180 days after the list of Privileged Partners is approved by EasyCase management.

Privileged Partner Validation is a necessity to get validation of granted cost-free service to Provider and the status of Privileged Agent by sending at least six patients at the online service EasyCase during Privileged Period.

Basic provider account is a free account with main essential information about Provider, its product, and services.

Premium provider account is an account granted for a charge with extended information about Provider, its product, and services.

Commission means the amount of money that Provider pays to EasyCase, based on a certain amount or a proportion of the medical expenses which are incurred when the Agent referees a patient to Provider and Provider provides medical services to the patient.

2. Status of the Terms of Service

2.1. The Terms of Service is developed by the Administration and defines the conditions for the use and development of the online-service EasyCase, as well as the rights and duties of Users and Administration. This document also applies to relations related to the rights and interests of third parties who are not Users of the online-service EasyCase, but whose rights and interests may be affected as a result of the actions of the Users.

2.2. The Terms of Service is a legally binding agreement between the User and the Administration, the subject of which is the provision of the online-service EasyCase.

2.3. The User is obliged to fully read the Terms of Service before registering on the the online-service EasyCase. Registration of the User on the online-service EasyCase means full and unconditional acceptance of the Terms of Service in accordance with Art. 437 of the Civil Code of the Russian Federation (public offer).

2.4. The Terms of Service may be amended and / or supplemented by the the Administration unilaterally without any special notification. The Terms of Service is an open and public document. The current version of the Terms of Service is located in the Internet at the network address: https://imtaa.org/en/terms.html.

2.5. The Administration recommends Users regularly check the Terms of Service for amends and / or supplements. Continuation use of the online-service EasyCase by the User after amends and / or supplements to this Terms of Service means acceptance and consent of the User with such amends and / or supplements.

3. Status of the online-service EasyCase

3.1. The online-service EasyCase is an Internet resource and a collection of information and computer programs contained in an information system that provides the availability of such information in the Internet at the network address https://easycasemed.com/.

3.2. All rights to the online-service EasyCase and to the use of the network address (domain name) https://easycasemed.com/ belong to the Administration. The Administration grants access to the online-service EasyCase to all interested parties in accordance with the Terms of Service and the current legislation of the Russian Federation.

4. Online-service Administration

4.1. Under the online-service Administration (hereinafter referred to as the Administration), in the Terms of Service and other special documents posted on the online-service are understood to mean EasyCase, a legal entity created under the laws of the United States of America and registered at 160 Greentree Drive, Ste 101, Dover , DE 19904.

4.2. Appeals, proposals, claims and other requests of individuals and legal entities to the Administration related to the Terms of Service or the work of the online-service EasyCase, as well as requests of authorized state bodies may be sent to the address specified in clause 3.1., or to the email address info@easycasemed.com.

4.3. With regard to the functioning and development of the online-service EasyCase, the Administration is governed by the laws of the Russian Federation, the Terms of Service and other special documents which are developed or may be developed and adopted by the Administration in order to regulate online-service EasyCase, including third-party services.

4.4. No clauses of the Terms of Service give the User the right to use the company name, trademarks, domain names and other distinctive signs of the Administration. The right to use the company name, trademarks, domain names and other distinctive signs of the Administration may be granted only by written agreement with the Administration.

4.5. The Administration has the right to perform preventive maintenance in the software and hardware complex of the online-ser with the temporary suspension in operation, if possible at night and as much as possible reducing the time of inoperability of the online-service, notifying the User about this, if technically possible.

5. User registration

5.1 In order to use the online-service EasyCase, the User agrees to provide true and complete information about himself in the Registration Form and in the Personal Profile and to keep this information up to date. If the User provideы incorrect information or the Administration has serious reasons to believe that the provided information is incomplete or unreliable, the Administration has the right to block the User account and / or restrict the access in using the online-service EasyCase. The Administration reserves the right at any time to demand confirmation of the data specified by the User at registration and request the proving documents, the non-submission of which can be equated with providing of unreliable information and lead to the corresponding consequences.

5.2 The User is obliged, at the request of the Administration, to provide documents confirming the legal status of the User and other data provided by the User upon registration on the online-service EasyCase. In case of non-submission or providing not all confirming documents by the User, the Administration has the right to refuse the registration or register in a different type of registration.

5.3. The registration on the online-service EasyCase means accept the Terms of Service, the User confirms his consent to the processing by the Administration of the personal data provided at registration, as well as posted by the User voluntarily in the Personal Profile. The processing of the User's personal data is carried out in accordance with the Privacy Policy of the online-service EasyCase, located in the Internet at the network address: https://imtaa.org/en/privacy.html.

5.4. The Terms of Service establishes the conditions under which the rights to use personal data such as information that constitutes medical secrets at the certain sections of the online-service Easycase (Agents Inquiries for Treatment, Treatment Program) may belong to User who have independently created and / or posted these information without the direct involvement of the Administration.

5.5. The User's IP address, information from the cookie, information about the browser are not personal data of the User. The Administration can use this information to monitor and analyze trends, track the movements of Users in online-service EasyCase, collect demographic and geographical information about Users in general. The administration has the right to provide statistical and other studies based on impersonal data.

5.6. The registration on the online-service EasyCase means accept the Terms of Service, the User confirms his consent to receive newsletters from the Administration containing information about products, services, special offers and promotions. If the User does not want to receive such information, he has the right to unsubscribe from newsletters using a special form contained within the mailings.

5.7. The email address (login) and password indicated by the User are necessary and sufficient information for the User to access the online-service EasyCase. The User does not have the right to give his login and password to third parties, bears full responsibility for their safety, independently choosing the way of their storage

5.8. The User must be responsible for the safe shutdown of his Personal Profile (using the "Exit" button). The Administration is not liable for possible data losses that may occur through violation of the Terms of Service, the Privacy Policy.

6. Financial relations

6.1. Services for charge are services of interaction organization for Users resulting in getting a patient for treatment from Agent to Provider.

6.2. Cost of EasyCase services directly depends on an amount of actually rendered medical services by Provider from patients referred by Agents at the online service EasyCase and regulated by a signed agreement between EasyCase and the Provider.

6.3. Services for charge are additional services, that Users can order in the online-service EasyCase according to their needs.

7. Force Majeure

7.1. In the event of force majeure, neither Party shall be liable for the full or partial failure to perform any of its duties if the failure is a result of circumstances such as flood, fire, earthquake, other natural disasters, war or military actions and other circumstances force majeure, not dependent on the will of the Parties.

8. Final clauses

8.1. The Terms of Service is governed and interpreted in accordance with the laws of the Russian Federation. Issues not regulated by the Terms of Service shall be resolved in accordance with the legislation of the Russian Federation.

8.2. If at some reason, one or more of the clauses of the Terms of Service are found to be invalid or unenforceable, this does not affect the validity or applicability of the remaining clauses.
